These Terms of Service ("Terms") govern your use of the Habits & Goals mobile application and related services (the "App"), provided by Habits & Goals ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that any information you provide is accurate.
2. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us promptly at support@habitsngoals.app of any unauthorized use of your account.
3. Subscriptions & Payments
The App offers a premium tier, Habits & Goals Pro, available through the following purchase options:
- Monthly auto-renewing subscription
- Yearly auto-renewing subscription
- Lifetime one-time purchase
3.1 Billing & auto-renewal
- Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
- Auto-renewing subscriptions renew automatically for the same period unless canceled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
- The one-time lifetime purchase is a single charge and does not renew.
3.2 Managing & canceling
You can manage or cancel your subscription in your Apple App Store or Google Play account settings. Deleting the App does not cancel a subscription. Subscriptions and purchases are processed by Apple and Google and managed via RevenueCat, Inc.
3.3 Refunds
Purchases are subject to the refund policies of the Apple App Store and Google Play. Except where required by law, we do not directly process refunds. Please contact the respective store for refund requests.
3.4 Free trials & pricing changes
If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Prices may change; where required, we will provide notice and, where applicable, request your consent before a change takes effect.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful or harmful purpose.
- Attempt to reverse engineer, decompile, or gain unauthorized access to the App or its systems.
- Interfere with or disrupt the integrity or performance of the App.
- Upload or share content that is illegal, abusive, infringing, or violates the rights of others.
- Harass, spam, or harm other users within communities, groups, or challenges.
6. User Content
You retain ownership of the content you create in the App (habits, goals, notes, and community posts). You grant us a limited license to host, store, and process that content solely to operate and provide the App. You are responsible for the content you share, and you represent that you have the rights to share it.
7. Intellectual Property
The App, including its design, text, graphics, and software, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Third-Party Services
The App integrates third-party services, including RevenueCat, Apple, and Google. Your use of those services may be subject to their own terms and policies.
9. Disclaimers
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure. The App is intended for self-improvement and is not a substitute for professional medical, psychological, financial, or other professional advice.
Health and medical. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition. Step, sleep, trend, correlation, and capacity figures are supplied by your device or entered by you, are not clinically validated, and are provided for general wellness only. Content generated by the AI coach is not medical advice. Always consult a qualified healthcare professional about your health, and before you begin or change any exercise, sleep, diet, or wellness routine. Never disregard or delay professional medical advice because of anything you have seen in the App. If you believe you may have a medical emergency, contact your doctor or your local emergency number immediately.
10. Limitation of Liability
To the maximum extent permitted by law, Habits & Goals and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Termination
We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that could cause harm. You may stop using the App at any time and request account deletion. Provisions that by their nature should survive termination will survive.
12. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Dhaka, Bangladesh, without regard to its conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh, unless otherwise required by applicable law.
